Bill on the Approval of Convention No. 108

A bill was presented approving Convention No. 108 for the Protection of Individuals with regard to Automatic Processing of Personal Data.

As previously informed, in September 2017 the Committee of Ministers of the Statute of the Council of Europe agreed to Argentina’s request to be invited to accede to Convention No. 108 for the Protection of Individuals with regard to Automatic Processing of Personal Data, signed in the city of Strasbourg on January 28, 1981 and its additional protocol, signed on November 8, 2001 (further information here)

In this regard, on February 23, 2018 a bill was presented to approve Convention No. 108 on the Protection of Individuals with regard to Automatic Processing of Personal Data. The objective of Convention No. 108 is to guarantee the fundamental rights of individuals, in particular with regards to the right to a private life, in connection with the automated processing of personal data.

Among other things, Convention N° 108 regulates the manner in which personal data is handled, processed, registered, stored and used, as well the processing of data on ethnic, political, religious or any other convictions, and any data related to an individual’s health, sexual preferences or criminal records, which may not be subjected to automated treatment unless the appropriate guarantees are provided.
