Employers with more than 100 workers must have nurseries and day care centers within a 1-year term.

This obligation was already provided for in Section 179 of Labor Contract Law since 1975, but had never been regulated. Last year, the Supreme Court of Justice had ordered the National Executive to issue the relevant regulation.

Employers with more than 100 workers must have nurseries and day care centers within a 1-year term.

By means of Decree 144/2022 published today in the Official Gazette, the National Executive ordered employers with 100 persons or more working in their premises to have nurseries and day care centers for children of their personnel who are between 45 days and 3 years old.

 

Employers may outsource the implementation of the day care centers or implement them together with other employers.

 

Through collective bargaining agreements this obligation may be replaced by a non-remunerative payment.
