Argentina Accedes to Convention No. 108 on Data Protection

In September 2017 the Committee of Ministers of the Statute of the Council of Europe agreed to Argentina’s request to be invited to accede to Convention No. 108 for the Protection of Individuals with regard to Automatic Processing of Personal Data, signed in the city of Strasbourg on January 28, 1981 (more information here).

Recently, the Argentine Congress passed a law approving Argentina’s accession to Convention No. 108.

The Convention is the first binding international instrument which protects individual privacy against abuses on the collection and processing of personal data. The objective of Convention No. 108 is to guarantee the fundamental rights of individuals, in particular with regards to the right to a private life, in connection with the automated processing of personal data.

Argentina’s accession to the Convention supplements the local framework, which is based on Data Protection Law No. 25,326, the Argentine Constitution, and regulations issued by the Data Protection Authority.

The Convention will enter into force three months after the deposit of the instrument of accession with the Secretary General of the Council of Europe.
