Government Proposes Changes in Transportation Regime

The Bill the Executive Branch sent to the Congress proposes amending, among other matters, articles 1 and 6 of Law 24653 (Motor Cargo Transport). With this modification, the Executive seeks to streamline and digitalize the processes, and release the owners carrying their own goods from the burdens of the cargo transportation requirements.

To this end, article 1 proposes to expressly exclude from the provisions of Law 24653 the transportation of cargo for consumption, use, or commercialization of goods carried out by individuals or legal entities, producers or traders thereof, in any type of vehicle they own or that belongs to relatives up to the third degree, provided that the owner does not own more than one vehicle to carry out the transportation activity and that its main activity is not the transportation of cargo.

Article 6 proposes including the electronic form of registration to the Single Registry of Motor Transport (RUTA). The enforcement authority must implement it within 180 days.

Thus, the Bill proposes eliminating the possibility of requesting any other information other than the following documents necessary for registration:

  1. title deed of the vehicle to be registered or equivalent document,
  2. proof of mandatory insurance coverage according to the type of vehicle and category of the carrier,
  3. technical inspection certificate.

As a requirement for maintaining the registration in RUTA, the Bill proposes extending from two to three years the term in Law 24653, during which at least one technical inspection of the vehicle must have been carried out.

Finally, the Executive also proposes amending article 6 and repealing articles 49, 50, 52, and 53 of Law 24921 (Multimodal Transportation of Goods), to eliminate the registration of multimodal transportation operators.
