Declaration of emergency of the national energy sector

Today, the Executive published in the Official Gazette the decree of necessity and urgency declaring the emergency of the national energy sector concerning the generation, transportation, and distribution of electric power under national jurisdiction and the transportation and distribution of natural gas until December 31st, 2024.

Declaration of emergency of the national energy sector

Among other matters, this decree:

 

  1. Instructs the Secretary of Energy to implement mechanisms for: (i) the enforcement of prices under conditions of competition and free access; and (ii) the maintenance of the real levels of income and the coverage of investment needs, to ensure the continued provision of public services of transportation and distribution of electric power and natural gas under adequate technical and economic conditions for suppliers and users of all categories.
  2. Determines the beginning of a tariff review for the public utilities’ suppliers of the transportation and distribution of electric power under national jurisdiction, and the transportation and distribution of natural gas, whose resulting tariff charts shall be in force by December 31st, 2024.
  3. Intervenes the Board of Directors of ENRE and ENARGAS as from January 1st, 2024, until the end of its members’ selection process.
  4. Entitles the Secretary of Energy to appoint the intervenors of ENRE and ENARGAS and confers certain specific attributions to them.
