Argentina Creates a COVID-19 Vaccination Database

By means of Provision No. 06/2021, the Undersecretariat of Open Government, operating under the Office of the President’s Chief of Staff, created a COVID-19 Vaccination Database to organize and expedite the administration of vaccines authorized by applicable entities and jurisdictions in the fight against COVID-19, and thus contribute to preventing and reducing the health crisis caused by the virus.

In compliance with Section 22 of Personal Data Protection Law No. 25,326, which stipulates that “[r]egulations on the creation, modification or deletion of files, records or databases of public entities requires a general provision published in the Official Gazette,” Provision No. 06/2021 states that:

 

  • The COVID-19 Vaccination Database (hereinafter, the Database) is a digital database that will contain personal data of users of the Cuid.AR app who request and obtain an appointment for the administration of any of the authorized vaccines against COVID-19. Personal data includes ID number, gender, province, zip code, cell phone number, e-mail address, place of vaccination, assigned vaccination date, type of vaccine, and dose number.

 

  • The entity responsible for the Database is the Undersecretariat of Open Government, operating under the Office of the President’s Chief of Staff (hereinafter, the Undersecretariat).

 

 

  • The Undersecretariat will transfer all personal data provided by users to Federal Public Sector entities (pursuant to Section 8, subsections a), b) and c), of Financial Administration and Public Sector Control Systems Law No. 24,156), in accordance with Section 1 of Administrative Decision No. 431/2020 of the Office of the President’s Chief of Staff.

 

The Undersecretariat is authorized to transfer personal user data only in connection to the health crisis proclaimed by Presidential Decree No. 260/2020 and within the framework of the powers granted to authorized entities. Whenever possible, the Undersecretariat must transfer personal data in a dissociated format.

 

 

  • The Undersecretariat is authorized to transfer the personal data provided by users to the health authorities of the respective provincial and municipal governments (including the City of Buenos Aires), if the Federal Government has obtained user consent to that end.

 

Users (data subjects) can file claims to exercise their rights of access, rectification or erasure before the Undersecretariat, located at Avenida Pte. Roque Sáenz Peña 788, 6th floor, City of Buenos Aires.
