Novedades relevantes en materia de protección de datos personales |
La Dirección Nacional de Protección de Datos Personales, autoridad de contralor de la Ley de Protección de Datos Personales N° 25.326, ha sancionado tres nuevas disposiciones que regulan aspectos vinculados a las fiscalizaciones que realiza dicha autoridad, el registro de bases de datos y las transferencias internacionales de datos personales.

Mercado de Capitales
Marval, O’Farrell & Mairal organizó el desayuno de trabajo “Un nuevo Mercado de Capitales argentino. Análisis del proyecto de Ley para su reforma”, que contó con exposiciones de Santiago Carregal, Roberto E. Silva (h), Pablo Gayol y Fernando M. Vaquero, y que se llevó a cabo en nuestras oficinas el 30 de noviembre de 2016.
Roberto E. Silva (h) disertó sobre “Actualidad normativa según las últimas modificaciones regulatorias sobre los productos fiduciarios y expectativa de cambios en la Ley de Mercado de Capitales” en el “VIII Foro Anual - Fideicomisos, Mercado de Capitales y Economía Real en la Argentina que Viene” organizado por CAFIDAP en la Bolsa de Comercio de Buenos Aires el 22 de noviembre de 2016.
Santiago Carregal integró el panel sobre “Novedades y desafíos jurídicos del mercado de capitales” en las “29as. Jornadas de Derecho Bancario” organizadas por el Comité de Abogados de Bancos de la República Argentina el 11 de noviembre de 2016.

Ricardo W. Beller actuó como moderador del panel “Acceso Regional a los Mercados de Capitales en 2016” en la conferencia del Oil & Gas Council celebrada en Buenos Aires los días 29 y 30 de noviembre de 2016.

Héctor A. Mairal disertó sobre “Regulación y lucha contra la corrupción”, Luis E. Lucero sobre “El desafío de las restricciones provinciales al desarrollo de la minería” y Enrique V. Veramendi sobre “Paneles técnicos (dispute boards) y contratos de PPP” durante el desarrollo del “XI Congreso Iberoamericano de Regulación Económica, Infraestructura y Servicios Públicos: Infraestructura pública, desarrollo económico y social”, organizado por la Asociación Iberoamericana de Estudios de Regulación y la Universidad Católica Argentina, en Buenos Aires, del 23 al 25 de noviembre de 2016.

Impuestos para abogados de empresas
Marval, O'Farrell & Mairal patrocinó el “Programa Corporate Taxation - Impuestos para abogados de empresas” bajo la dirección de María Inés Brandt que se llevó a cabo en Buenos Aires el 23 de noviembre de 2016. En el mismo se expusieron los siguientes temas: (i) “El impuesto a las ganancias y los rubros derivados de la extinción del contrato de trabajo. ¿Qué casos resolvió el precedente Negri?- Situación actual”, a cargo de Sergio D. Vergara; (ii) “Deducibilidad de gastos de financiamiento. Principio de universalidad del pasivo. Un repaso a través de la jurisprudencia más relevante”, a cargo de Mariana Batalle; (iii) “Planificación fiscal de una reorganización societaria. La redomiciliación de sociedades argentinas hacia el exterior”, a cargo de Daiana L. Castro; y (iv) “Consideraciones sobre planificación fiscal mediante la utilización de Convenios para evitar la Doble Imposición a raíz del caso Molinos”, a cargo de Luciana M. Virgile.

Responsabilidad del Estado
Héctor A. Mairal disertó sobre “La responsabilidad contractual del Estado a la luz del Código Civil y Comercial y la Ley de Responsabilidad del Estado” en la jornada “Código Civil y Comercial. Algunas reflexiones a un año de su vigencia” organizadas por la Universidad Austral el 21 de noviembre de 2016.

Inversiones en la región
Francisco A. Macías disertó sobre “Oportunidades de inversión en la Argentina” en la Mesa Redonda sobre la Argentina que tuvo lugar en el Estudio Bredin Prat de París, y en el Desayuno de Trabajo celebrado en las oficinas del Estudio Pérez-Llorca de Madrid 24 y el 22 de noviembre de 2016, respectivamente.
Santiago Soria y Juan M. Diehl Moreno moderaron el panel “Perspectivas, desafíos y oportunidades para las inversiones en la región (Argentina, Bolivia, Brasil, Paraguay y Uruguay)”, celebrado en nuestras oficinas el 18 de noviembre de 2016. Los oradores fueron: Valeria Galíndez (Uría & Menéndez, San Pablo), Sandra González (Ferrere, Uruguay), y Pablo Ordoñez (Ferrere, Bolivia).

Mariano J. Peruzzotti fue designado Presidente del Comité Latinoamericano del Grupo de Trabajo de Privacidad de The Sedona Conference. The Sedona Conference es una asociación sin fines de lucro dedicada a la investigación y educación cuya misión es el estudio del derecho en las áreas de antitrust, litigios complejos y propiedad industrial e intelectual. |

Arbitraje
Santiago Soria disertó sobre “Prueba en el arbitraje internacional y los distintos estándares aplicables: producción de documentos” en la Conferencia de la ICC en Buenos Aires, celebrada el 17 de noviembre de 2016.
Santiago también participó como árbitro en la competencia “FDI Moot 2016” que tuvo lugar en la Universidad de Buenos Aires del 3 al y 6 de noviembre de 2016.

Marcas
Gustavo Giay participó como moderador del panel: “Negociación en vivo: el bueno, el malo y el feo: todo es cuestión de perspectiva”, durante la Conferencia de Líderes de International Trademark Association (INTA) realizada en Hollywood, Miami, del 16 al 18 de noviembre de 2016. Durante la conferencia, presidió la reunión del Comité Global Asesor para Latinoamérica de INTA, y, en su calidad de exmiembro del Directorio, fue invitado como orador a la reunión de orientación para los nuevos miembros del Directorio que ingresarán en el 2017.
Martín Chajchir disertó sobre “Marcas y Mediación” en el webcast “Desarrollando la Mediación en Propiedad Intelectual en Diferentes Culturas: Una Conversación entre Neutrales de América Latina y la Unión Europea” organizado por International Trademark Association (INTA) el 9 de noviembre de 2016.

Ignacio Sánchez Echagüe moderó el panel “Herramientas para enfrentar los desafíos en innovación” correspondiente al Seminario “Innovación y Colaboración en Salud en Argentina” organizado por la Universidad Católica Argentina el 14 de noviembre de 2016.
Ignacio también disertó sobre “Patentes y marcas en la Argentina” en la Japan External Trade Organization (JETRO), en Tokio, Japón, el 14 de octubre de 2016.

Brecha de género
Patricia López Aufranc fue invitada por los estudios Guyer & Regules, Ferrere Abogados, Hughes & Hughes, Posadas & Posadas, y Jiménez de Aréchaga, de Montevideo, Uruguay, a realizar un taller sobre “Entendiendo la brecha de género: estereotipos y prejuicios inconscientes” el 11 de noviembre de 2016, en el marco de la 2ª Conferencia del Programa Women in the Profession del Cyrus Vance Center for International Justice.
Patricia también disertó en el Congreso Bianual del Consejo de Profesionales de Ciencias Económicas sobre “Liderazgo en tiempos de grandes transformaciones” en Buenos Aires el 10 de noviembre de 2016.

Compliance - Anticorrupción
Patricia López Aufranc habló sobre “Implementación de Programas de Compliance” en el Campus Argentina organizado por el Colegio de Abogados de París en Buenos Aires el 10 de noviembre de 2016.
Patricia también fue oradora en el Congreso Anual de la Unión Internacional de Abogados celebrado en Budapest, Hungría, del 29 de octubre al 1 de noviembre de 2016, donde expuso sobre “Compliance: desafíos y oportunidades para la profesión”. También integró la Comisión de Fusiones y Adquisiciones donde expuso sobre fusiones de estudio jurídicos.
Claudia Paluszkiewicz participó de la reunión de la Comisión de Seguimiento del cumplimiento de la Convención Interamericana contra la Corrupción, que se llevó a cabo el 10 de noviembre de 2016.
Rodrigo Fermín García integró el panel sobre “Corrupción. Crimen contra la humanidad. Estrategias para financiar y efectuar recuperaciones sustanciales de valor” en la “5ª Conferencia sobre Fraude, Rastreo y Recuperación de Activos” celebrada en Miami, EE.UU., el 17 y 18 de octubre de 2016.

Tecnología de la información
Diego Fernández participó como orador en el 4° Encuentro Anual de Abogados organizado por Artículo Uno y AUNO Abogados el día 4 de noviembre de 2016 en la Ciudad de Buenos Aires. Diego participó en el panel sobre el futuro de los estudios jurídicos y disertó sobre la tecnología aplicada a la profesión.
Por otra parte, Diego fue nombrado nuevamente por International Technology Law Association (ITechLaw) como vice-presidente del Comité de Sudamérica por el período 2016-2017.
